This Application is provided and operated by Linkz Asia Holdings Pte Ltd or one of its affiliates where the Application is serving and accessible, and these Terms & Conditions of Use ("T&Cs") apply to users who use this Application to access data and information solely owned by a tax resident of the Republic of Indonesia (Indonesia), Republic of Singapore (Singapore), Malaysia (Malaysia), Kingdom of Thailand (Thailand), Republic of the Philippines (Philippines), Socialist Republic of Vietnam (Vietnam) (jointly shall be referred to as “Affiliates”). In these T&Cs, the terms “we”, "us", "our" and “LINKZ” refer to Linkz Asia Holdings Pte Ltd and/or its Affiliates. The terms "I", "user" “you”, and "your" refer to a user of the Application. These T&Cs constitute a legal agreement between you and LINKZ. If you do not agree to these T&Cs, please do not use the Application.

DATA INTEGRITY

You hereby represent and warrant that all information, data and other details you have submitted to LINKZ are true, accurate, current and complete. In the event any changes of data from time to time, you are responsible for updating and correcting such data to LINKZ.

PRIVACY POLICY

You agree that all information and personal data you have submitted to LINKZ through the Application, or via email, telephone or other forms of communication may be accessed, collected, stored, processed, used and shared in accordance with our Privacy Policy. We have the right to change or update the Privacy Policy at any time and such changes will take effect immediately upon their posting online or on the Application.

LICENSE AND ACCESS TO APPLICATION

All content provided on the Application is the property of LINKZ and its licensors or content providers, and under the protection of copyright, trademark and other applicable laws and regulations in the region where LINKZ operates. LINKZ grants you a limited license to access and make use of this Application. Unless stated otherwise, you have permission to access, copy, download and print content provided on the Application for legal use, as long as you do not change or remove any copyright, trademark or other proprietary notices in the content. LINKZ and its licensors or content providers reserve the rights to all content provided on the Application, including intellectual property rights, and provide this content by a license that can be revoked at any time in accordance with LINKZ’s policy. LINKZ strictly prohibits any misuse of content provided on the Application, including, but not limited to: any downloading, copying or other use of content to compete with LINKZ or to benefit other vendors or third parties; all unauthorized caching and linking to the Application or illegal framing of content available on the Application; all changes, distribution, deployment, execution, broadcast, publication, uploading, licensing, manipulation, transfer or sale, or derivative work creation, from all content, products or services available on the Application that you do not have the right to use. All uploads, transmission or deployment of materials containing software viruses or computer codes, files or programs designed to disrupt, interfere with or restrict computer use; the use of hardware or software to intercept, or extract information (i.e. system data or personal information) from the Application, including, but not limited to, the use of scraping or any data extraction methods, robots, spiders or similar tools; or any actions forcing or which may force an overload or unreasonable or disproportion usage or damage which interrupts the operation of LINKZ infrastructure; are prohibited. LINKZ reserves the right to terminate your account on the Application, to ban any party from the Application and prohibit Application use for any reason, and limit or restrict you from accessing the Application, at any time without notice. LINKZ does not guarantee or warrant that any content used on the Application does not violate the rights of any third parties with no affiliation to LINKZ. The termination of access or use will not put aside or affect any other rights or relief of LINKZ, under the law or in equity.

The Application may contain links to other applications or resources operated by third parties with no relationship to LINKZ. The provided links are intended to provide additional information for you to access. We are not responsible or liable for any content, advertisements, products or any materials contained in the aforementioned applications or sources. The linking of other applications or resources does not represent any manner or any form of endorsement or support for the aforementioned linked applications or sources. There may be differences in the terms and conditions and privacy policies applicable for the use of linked applications and resources. LINKZ is not responsible or liable for any damage, loss or liability caused, or allegedly caused by, or related to the use of or reliance on any content, products or services provided in or through linked applications or resources.

SELLER

The term "Seller" refers to a user who uses the Application to market and sell their own goods. Each Seller will be charged a service fee by LINKZ for every sale transaction of goods at the amount that will be informed to the Seller ("Service Fee"). Each Seller agrees to conduct the business of selling goods on the Application in good faith and in compliance with LINKZ’s regulation and the applicable laws so that mutually beneficial cooperation can be established in fulfilling their respective rights and obligations both with LINKZ and Buyers. Each Seller shall enter all information related to the goods correctly, accurately and honestly, and each Seller agrees that all information submitted on LINKZ is fully the responsibility of the Seller. To avoid the failure of ordering the goods by Buyers, each Seller shall ensure that the stock availability status of the Seller's goods is correct and accurate at all times.  Each Seller acknowledges and agrees that he or she will not conduct direct buying and selling transactions which bypass or circumvent the Application or these T&Cs. LINKZ in any circumstances shall not be held responsible for every consequences and risks arise from or related to the direct buying and selling transactions which bypass or circumvent the Application or these T&Cs.

BUYER

The term "Buyer" refers to a user who uses the Application to make purchases of goods. Each Buyer is deemed to have read, understood, and agreed the overall information/description of the goods (including but not limited to price, unit, type, shape, color, quality, and others) before making a purchase of the goods. Buyers may use or utilize the chat feature in the Application to communicate with Sellers.  Each Buyer understands and agrees that stock availability of the goods is the responsibility of the Seller who offers and sells the goods. Regarding the availability of the stock of the goods, it can change at any time, so when the stock of the goods is empty, the Seller can refuse the order, and if there has been a payment for the goods, the Seller is personally responsible to ensure that the payment is returned to the Buyer. LINKZ is not liable and does not hold the responsibility whatsoever, to recover such payment. The Buyer is obliged to confirm receipt of the goods through the Application, after receiving the goods and the transaction is considered complete.
